Next time I'll be sure to do this. I tried this at first, but file was too big.(.tar.gz, .tar, .tgz, .zip, and .bz2)
I am using external server for all downloads.

Even if it is derived from GPL work (the Apple backgrounds GPL'ed?) you need to provide the source, or "preferred form of the work for making modifications to it," for the GPL to be applicable. Which you have not done.

I can't speak for the background, but the tux is mine... as in, I made it. I released it under the GPL, so he's perfectly within his right to use it.
