well in my opinion this can be a good thing in the long run.
all we have to do is start to have lots and lots of new ideas, and posting them somewere. as an example gui aspects kan easely be made in karamba, because its the looks and the idea that counts, not if it is well made, that can come later.
That way we can have all the ideas first and block the patent azerdous efects.

Forget about that! There are so many patents already only waiting to be made effective...!
If software patents are granted in Europe the way they are in America, we can COMPLETELY forget about developing software in Europe. US companies(and Japanese) are so much ahead of us because software patents are allowed there so that there would be not the least chance for European companies to survive.
Me for example would have to move to America, because I certainly couldn't find a job here in Europe any more.

Did you know, that there are already patents in the queue, that would patent something simple like email?

So you can forget about kmail.

The big problem ist the huge backlog of already pending software patents that are just waiting to become legal and then the owner can let their lawyers go.

To mess up a Linux box, you need to work at it; to mess up your Windows box, you just need to work on it.

Patents are good for the few, but bad for everyone else. If Linus closed the source for Linux, it probably would not be as popular as it is today. Yes, he would be richer than he is now, but clearly, money was not his motivation. Unfortunately, he does not fall into the category of a typical person - greedy and self-centered. Patents re-inforce the greed in people and do nothing to benifit the community as a whole. Well, wait a minute... The patent for the cardboard sleeve on Starbuck's coffee cups is great. D'oh!!

Could the following happen?

Software patents are approved and a licensing and checks system is setup to verify if the software *you* are using is legitimately licensed. Licensing sandards are put in place to charge *you* per year, per month, per app use, or whatever. How much will *you* have to pay for a license in order to enjoy what you already do? Businesses get onboard in order to comply with new laws. When *you* try to connect to the internet, your ISP checks your license and, if approved as legit, you are allowed to connect, surf the net, perform email functions, etc. If you are not found to have a legitimate license, you simply get an error stating that you are not allowed to connect to your ISP due to a lack of a legitimate license. Where will that leave *you*, the end-user?

This has oppression written all over it.

This is not exactly what patents are about.

Patents are a govermental grant, exclusive rights for a limited period of time, 20 years. They were designed for good old industry and liberal economists hate them as they are a inefficient instrument.

An instrument for the benefit of laywyers

do we really NEED the freakin ad about the software patents on EVERY SINGLE PAGE? i find it very annoying, since we ALL REALIZE that software patents are a bad idea. why not just do like every other website, and put it on the FRONT PAGE, and leave the rest of the pages alone? and on another note, why do i have to go through EVERY SINGLE PAGE to get to the wallpapers that i want, since i know the letters they begin with?

At one time they used to be a good thing in the U.S., but then greed and slick lawyers got involved then it got out of hand. If you had an idea, and someone else came along trying to steal your idea, the patent stopped them from doing that, but then the patent was only so you would have time to actually get your product to market and make something, then after awhile it would expire and then be public domain.

But slick lawyers and greedy companies now renew them, and nothing seems to go to public domain anymore. Once that started happening, patents became a big stick to beat up anyone not holding one. They only benefit lawyers anymore, for they get the bucks to beat everybody up, and extort the company holding them, to do it.

Patent protection was brought in for a good reason and has worked well for it's purpose in it's time. Has anyone considered the speed of developement in software compared to the industries that were around when patents were introduced? Perhaps software patents could be a good thing if they were valid for 6 months? no more than a year I think. It could well be easier to achive this than stop patents altogether, or if not, is still available to lobby for if patents become enforced.
