Not! If you do a style that looks like Mosfet's and the code even looks slightly similiar you can get sued. If your going to be doing styles, *don't* base it off this. You'd have to do a "clean room" implementation, so I wouldnt' even look at the code.

As mentioned on the other Liquid thread, it is actually true that Duley would have to travel to Norway and file suit in Oslo city court in order to sue you over Liquid. That is the governing law clause in the QPL included in the tarball. He apparently chose the license himself just so Liquid's code couldn't be used by KDE code covered by the GPL, which has no governing law clause and thus no such limitation. Stallman may be a nut job but if so, few nut jobs are as good at catching little details that can derail their movement.

Now, incorporating his code into GPL'ed software (as someone claiming to be Duley hysterically insisted I was recommending on the other thread) is a foolish idea at best. But it seems to me that studying his code would be about as safe as what various GNU utility authors, XFree86 developers and kernel maintainers have done in the last decade, reimplementing previously published API's. I also feel very sure that Duley didn't patent any of the algorithms he used, the other landmine in reimplementing non-free software.

There is always the chance that someone can sue you, no matter who you are, who they are, or what you're doing. Microsoft could decide to sue the KDE developers over the "K menu" tomorrow, knowing even though they have no case it would be too costly for them to defend. They wouldn't do that right now due to their issues with the DOJ, but nothing says they couldn't; they certainly have the cash and lawyers.

Likewise, Duley could and should pursue a clear violation of his copyright, but would he risk his own money on a murky, unclear, alleged indirect violation against something he professes no interest in anymore? That would be the important question for someone implementing a fake Aqua theme and wanting to examine Duley's ideas for speeding things up.

Truth be told, I'd worry more about Apple suing me over look and feel if I were to try to implement something like Liquid. Every author of GPL'ed software is just as vulnerable to someone with deep pockets publishing a closed source version of their work, but at least they have their choice of venue to make their case.

Don't kid yourself. Imaginary property law is 5% legal standing and 95% money and politics. You can produce zero code or you can assess your legal risks and take your chances.

Mosfet is the Prima Donna? Your the one telling people to take their chances and break the QPL. What have you done to contribute to Linux except tell people your amatuer legal advice? No wonder he has left you stupid people behind. A thought for you is that all the sources are still copyrighted with "All rights reserved", which gives Mosfet rights to his code and protecting it. As far as the Norway thing, you may note that crimes that occur in the US can be prosecuted here. Mosfet can prosecute a copyright violation in the states regardless of the disclaimer. If a Norwegian company has a copyright dispute, it can be settled either in the US *or* Norway - both countries law's apply. While he said he has abandoned Linux, all his work is still copyrighted and can be protected in the US. It's not yours and he can do what he wants with it. Get over it.

Since people still seem to think that my QPL isn't enforceable, I'm pleased to note that I've consulted the legal department at the company I work for (which is planning to use the style in Windows applications). The license of Liquid *can* be enforced in the US, and violations can be processed in the usual manner (cease and desist first, followed by injunctions and trial). Since this is going to be used in a product, it's likely to be enforced. The funny thing is, I was originally going to relicense it as BSD software when I decided to leave Linux, but the general hostility and rudeness of the user base has made me change my mind. I have no motivation to do anything for the weasel users such as these. People keep on trying to get me to relicense code by insults. Very stupid but typical of the Linux user base.

Even if Mosfet's newer versions of Liquid are covered by the QPL, that doesn't mean that earlier versions that were realeased under the GPL can't be used. Mosfet is a talented programmer and artist but I know by the quality of KDE that there are many other ones that could develop Liquid into something that surpasses the original. If none of them are interested though, I'd love to try to create something wonderful from it and I could even learn some C++ from it. :)
As for Mosfet being upset with the entire Linux community just because he had problems with one part of it, I don't know the details of what happened but even when I read his side of the story, I still felt that the KDE group did nothing wrong and he needs to accept that he can't always have his way.

All versions from 0.2 on are QPL, and it's improved a lot since 0.1.
